Foxy Brown flashes a thumbs-up as she leaves a New York court on Tuesday. The criminal case against the rapper was dropped after the victim refused to testify..

The Brooklyn district attorney's criminal case against Foxy Brown collapsed Tuesday after the victim refused to testify that she was mooned by the rap diva.

Brown, 32, whose real name is Inga Marchand, hugged her lawyers after Justice John Walsh dismissed the misdemeanor charge of violating an order of protection.

Assistant District Attorney Robert Isdith said complainant Arlene Raymond told him late last week that she did not want to take the stand at the trial scheduled to begin Tuesday in Brooklyn Supreme Court.

A source familiar with the case said Raymond told prosecutors that her lawyer had concluded there was no money to be made by suing Brown so she did not want to cooperate any further in the criminal case.

Brown's lawyer Salvatore Strazzullo announced he intends to sue the city, the NYPD and the D.A.'s office for malicious prosecution.

Strazzullo confidently stated that he would have proved Raymond was lying about the July 2010 incident.

"Our big ace in the hold is she (Brown) wasn't wearing any underwear," he said.

While Arlene claimed in police reports that she could see Brown's underwear when she mooned her, Brown was ready to testify that she was wearing a very tight dress on the day in question which precluded wearing panties, Strazzullo said.

Brown, who was convicted of beaning Raymond with her BlackBerry in 2007, got in a few verbal jabs at the victim's expense.

"It's rooted in jealousy, it's a scarying thing like borderline obsession," she said. "Someone wants to be you and have the life I worked very hard for."

Reached by phone, Raymond denied that she was after Brown's money or her lifestyle.

"The case was getting in the way of my personal life, it's a headache," she told The Daily News.

"Her life is full of drama, why would I want a life of drama?"
